Next: Hearing will be continued to September 12th.
July 13, 2024 –This week we had our first victory, as the chief justice of trial courts in Massachusetts rejected Toll Brothers’ request to move our appeal to land court. Instead, our case will remain in Superior Court. This will put construction on hold until a judge is able to hear our case for the numerous environmental, flooding and safety issues posed by the 528 Boylston development.

On Jun 17, 2024, ‘Newton MA Impact’ filed an appeal in the Massachusetts Superior Court to challenge the ZBA’s decision to issue a comprehensive permit to Toll Brothers, Inc.

JULY UPDATES

July 27th

  • Reduction in units and parking spaces proposed by Toll Brothers the height and footprint of the building remains primarily the same.
  • Many of the Peer review studies remain outstanding.
  • Ward 8 Councilor Rick Lipof was among the residents who testified, offering his thoughts and expressing his support for the neighborhood and against the current proposal. He said while he is grateful to the petitioner for having reduced the number of units, the size of the buildings has not changed. He said he wished the project had come before Land Use and stated, “When developers choose to jump over the city and go to the state in the name of increased affordable housing, which is a good thing, we lose control. When I look at this site – I say to myself there’s a reason why it was a mulch site all of this time — because it’s really 2 1/2 acres and not 5.8 … because access is horrific … because that Route 9 bridge — to get to this site, people are going to be using the Parker Street bridge as a turnaround — every single time — it’s extremely dangerous.” In addition, he offered what he thinks would be a more appropriately sized development for this site, “75-100 units, 3-4 stories set back.”

  • THURSDAY, July 20, 2023, 8AM at the Site, 528 Boylston Street, this is a Public Meeting Site Visit, the ZBA Board will be in attendance, along with the town Planning & Zoning, Toll Brothers the developer and their Lawyers Steve Buchbinder, to survey the site in person. The public is invited to make comments, but no questions may be asked or directed to the ZBA Board.

  • Our voices seemed to speak loud and clear that major changes need to be made to the 528 Boylston Street Project during the ZBA meeting 5/24/23
  • Many city councilors and even ZBA members shared many of our same concerns at the meeting.

  • Numerous studies to be performed by Toll requested by ZBA including an independent peer review study of Transportation, stormwater and site design
  • A site visit by the ZBA in June open to the public, date to be announced.
  • Next ZBA meeting: Monday July 24th at 7PM, It will be a busy vacation time, but your continued voice is critical for change to this project so please mark your calendars.

May 1st 2023

  • Toll Brothers submitted their Comprehensive Permit for the 528 Boylston Street project to the ZBA on April 26th 2023
  • The first public hearing for this project will be on Wednesday, May 24th at 7PM
  • The meeting will be held in person at City Council Chamber Room 207 in City Hall, 1000 Commonwealth Ave, Newton & ZOOM:  https://newtonma-gov.zoom.us/j/81584842323 or call 1-646-558-8656 and use the Meeting ID 81584842323.
  • There is one agenda item before the 528 Boylston Street which should be short, but the rest of the meeting is dedicated to the 528 Project, the usual order of events is a presentation by Toll Brothers the Developer, followed by questions from the ZBA and finally community comments.
  • We ASK ALL supporters of Newton Impact /528 Petition to show their support by attending this meeting. It is critical to show your support by logging in when the meeting starts and staying logged in to the end of the meeting.
  • Over the past month we have been conducting tours of the site and the contiguous neighborhood to City Councilors and Toll Brothers representatives to show our concerns.  Everyone has indicated the concerns are valid and legitimate
  • We continue to ask all to spread the word to other Newton friends and families and by sharing this web site link and donating to our supporters fund
  • Attendance at this 1st ZBA meeting will make an “IMPACT in NEWTON”

APRIL UPDATES

  • Over 630 Newton neighbors and residents have signed the petition.
  • Mass Housing sent their site approval letter to Toll on February 1st, 2023.
  • We sent a letter and fact sheet to the Mayor, Planning Dept. and all of our City Councilors on March 14, 2023.
  • Toll Brothers will now seek a comprehensive permit from Newton’s Zoning Board of Appeals (“ZBA”).
  • The application filing is expected beginning April and will begin a 6-month review period.
  • We plan to meet with the City Councilors in the next few weeks to engage their support in representing the community’s concerns.
  • We continue to reach out to our neighbors to sign the petition, please share the petition and web site link to all your Newton friends and families.
